Terms of Service

These Terms of Service (“Terms”) govern your use of the AHIP Collect mobile application operated by EnBright Pty Ltd (ACN 685 093 805) (“we,” “us”). By downloading, installing, or using AHIP Collect, you agree to these Terms and our Privacy Policy.
1. About AHIP Collect
AHIP Collect is a professional NaTHERS compliance automation tool designed for accredited NaTHERS assessors and authorised data collectors. It automates on-site data capture, applies Technical Note defaults, and produces a structured AccuRate Enterprise import file.
AHIP Collect is a data capture and workflow tool, not a rating engine. The NaTHERS energy rating is produced by AccuRate Enterprise software (CSIRO). We do not produce, guarantee, or take responsibility for the accuracy of any energy rating. The accredited assessor remains solely responsible for the accuracy and integrity of every assessment, as required by NaTHERS accreditation conditions.
2. Eligibility
- You must be an accredited NaTHERS assessor, an authorised data collector under the NaTHERS framework, or an individual authorised by an accredited assessor to use the App.
- You must be at least 18 years old.
- You are responsible for ensuring your use of the App complies with your NaTHERS accreditation obligations.
3. Subscriptions and Fees
AHIP Collect is offered on a subscription basis. Current pricing is published on our website.
- Free trial/founding period: If applicable, trial terms will be clearly communicated at sign-up.
- Billing: Subscriptions are billed monthly or annually as selected. Fees are charged in advance.
- Renewal: Subscriptions renew automatically unless you cancel before the renewal date. We will send a renewal reminder at least 7 days before each renewal.
- Cancellation: You may cancel your subscription at any time through the App settings or by emailing us. Cancellation takes effect at the end of the current billing period. No refund for partial periods.
- Price changes: We will provide at least 30 days’ notice of any price increase. You may cancel before the new price takes effect.
4. Your Data and Intellectual Property
- Your assessment data: You (the assessor) retain ownership of all assessment data you create using the App. We store this data on your behalf and provide tools to export it.
- Property owner data: Property assessment data relating to homeowners is collected under the authority of the assessing assessor’s NaTHERS accreditation and the homeowner’s consent. We process this data on behalf of the assessor.
- Training data licence: Where an assessor confirms a classification as an on-site observation AND the property owner has consented, you grant us a non-exclusive, royalty-free licence to use the de- identified classification data (not photos, not addresses, not personal information) to train and improve our AI classification model. You may withdraw this licence at any time.
- Our intellectual property: The App, its design, code, algorithms (including the Defaults Engine, Quality Score Engine, and future AI model), and documentation are our exclusive property.
5. Assessor Responsibilities
You acknowledge and agree that:
- You are solely responsible for the accuracy of every assessment and rating produced using data from the App, as required by your NaTHERS accreditation.
- You must obtain informed consent from the property owner and tenant (if applicable) using the in- app consent flow before commencing any data capture.
- You must comply with all NaTHERS Technical Note requirements, including evidence standards and data retention.
- You must review photos for PII before submitting assessments.
- You must not share your account credentials with others.
6. Defaults Engine Disclaimer
The AHIP Collect Defaults Engine auto-applies values from the NaTHERS Technical Note (e.g., insulation R- values based on year of construction and climate zone). While we endeavour to ensure these defaults are accurate and aligned with the current version of the Technical Note:
- We do not guarantee the accuracy of default values. The Technical Note may be updated and defaults may change.
- The assessor remains responsible for verifying that applied defaults are appropriate for each property.
- We are not liable for any rating inaccuracy resulting from default values.
7. Limitation of Liability
Subject to any non-excludable consumer guarantees under the Australian Consumer Law:
- AHIP Collect is a data capture tool, not a rating engine. We are not liable for the accuracy of any NaTHERS rating.
- We are not liable for any loss, penalty, or regulatory action arising from an inaccurate assessment, whether or not the assessor relied on the App’s Defaults Engine, pickers, or export file.
- Our total aggregate liability for any claim under these Terms is limited to the fees you paid to us in the 12 months preceding the claim.
- We are not liable for indirect, incidental, or consequential losses, including loss of revenue, reputation, or accreditation.
8. Availability and Support
- The App is designed to operate offline. Core capture and assessment functions work without network connectivity.
- We do not guarantee uninterrupted availability of cloud sync, GEMS lookups, or pre-fill services.
- Support is provided via email during Australian business hours.
9. Suspension and Termination
We may suspend or terminate your access if you breach these Terms, your NaTHERS accreditation is revoked, or your use poses a risk to the platform or other users. Upon termination, you may export your assessment data for 30 days. After 30 days, data will be retained per our retention schedule (7 years for assessment evidence) but will not be accessible via the App.
10. Dispute Resolution
Disputes must first be raised with us in writing. If not resolved within 30 days, either party may pursue mediation. This does not prevent either party from seeking urgent interim relief.
11. General
- Governing law: Laws of New South Wales, Australia.
- Severability: Invalid provisions are severed; remainder continues.
- Entire agreement: These Terms and our Privacy Policy are the complete agreement.
- Changes: Material changes notified via in-app notification and email at least 14 days before taking effect.
